So the FBI continues to use pseudo-science to intimidate the very people who would know best that a polygraph is at best unreliable and worse a scam.

What concerns me more is that the DoJ has launched a criminaly investigation into The Atlantic and the reporter over the story that Patel is essentially a drunk. It's a huge concern for freedom of the press and is very likely to fail but still has a chilling effect on the press and is in line with Trump's vision of squashing all dissent.

Judge says Trump DOJ subpoenas of Tim Walz and other Democrats are unconstitutional​


A federal judge on Monday blocked the Justice Department from forcing Minnesota Gov. Tim Walz and other officials to turn over records in its probe of Democratic resistance to the Trump administration’s immigration crackdown, calling the move a retaliatory effort to “harass political opponents.”


In a 30-page ruling, district Judge Patrick Schiltz found that subpoenas were “part of an unconstitutional effort to coerce Minnesota officials into assisting the federal government with enforcing civil immigration laws and to harass and retaliate against them for failing to do so.”

“The Department is not conducting a criminal investigation, but is instead using the grand jury process for other (unlawful) purposes,” wrote Schiltz, an appointee of former President George W. Bush.

Schiltz said there is “overwhelming” evidence that the subpoenas were issued only to pressure the state officials, noting that senior Justice Department officials have repeatedly threatened to punish states that have so-called sanctuary policies. And, he said, the department “has struggled-without success-to identify a single plausible investigatory justification for the subpoenas.”

Frey also lauded the ruling, saying that “subpoenaing political opponents because they spoke on behalf of their constituents violates the core tenets of our democracy and human decency.”

The Justice Department argued this week that former FBI director James B. Comey intentionally threatened the life of President Donald Trump in a social media post in part to stir controversy and boost sales of his then-forthcoming novel.

Prosecutors laid out parts of their controversial case in motions late Tuesday against Comey, whom they charged in April with threatening the president by posting a photo on social media of seashells arranged to spell out “86 47.”

Trump is the 47th president, while “86” can mean banning or removing someone, and sometimes can also be slang for killing them. Comey, a longtime outspoken foe of the president, quickly removed the post after receiving criticism that the phrase could be used to communicate a threat of violence.


The latest prosecution motions were filed in response to arguments made last month by Comey’s defense attorneys that a federal judge should dismiss the case because the seashell photo did not constitute a true threat, and because the case amounted to an unlawful vindictive prosecution based on Trump’s personal hostility toward the former FBI director.

If it isn’t a true threat (and it takes a very delusional snowflake to think it is), so what if it was to boost book sakes (which is a bonkers claim).

The DOJ attorneys should be laughed out of court. Then sanctioned for wasting the court’s time.
 
Feds seize Eric Swalwell’s devices, search home as part of sexual assault inquiry. The former Democratic congressman, once considered a leading candidate in the California governor’s race, resigned after the allegations surfaced in the spring.

Federal law enforcement officials seized electronic devices belonging to former congressman Eric Swalwell (D-California) as part of an investigation of sexual assault allegations against him, according to two people familiar with the inquiry.

The FBI seized at least one of Swalwell’s electronic devices at San Francisco International Airport on Saturday evening, the people familiar said. His D.C. home was searched the next day, according to the people, who spoke on the condition of anonymity to discuss an ongoing investigation.

Swalwell has not been charged with any crimes.

Publicly available court papers confirm the seizure of an iPhone and laptop from Swalwell, but do not detail why they were taken. The searches were first reported by the Daily Mail.

One of the people familiar said that authorities are considering pursuing multiple federal charges. The court record associated with the search warrant shows that at least one of the possible crimes that federal authorities are looking at is whether Swalwell used his official government position to deprive a person of their constitutional rights.

Attorneys for Swalwell did not immediately respond to requests for comment Thursday.
